In these Rules the following words are employed, with the meanings set out below:

(a) 'Carrier' includes the owner or the charterer who enters into a contract of carriage with a shipper.

(b) 'Contract of carriage' applies only to contracts of carriage covered by a bill of lading or any similar document of title, in so far as such document relates to the carriage of goods by sea, including any bill of lading or any similar document as aforesaid issued under or pursuant to a charter party from the moment at which such bill of lading or similar document of title regulates the relations between a carrier and a holder of the same.

(c) 'Goods' includes goods, wares, merchandise, and articles of every kind whatsoever except live animals and cargo which by the contract of carriage is stated as being carried on deck and is so carried.

(d) 'Ship' means any vessel used for the carriage of goods by sea.

(e) 'Carriage of goods' covers the period from the time when the goods are loaded on to the time they are discharged from the ship.

Các doanh nghiệp  kinh doanh khai thác cảng biển và doanh nghiệp quản lý luồng hàng hải do doanh nghiệp tự đầu tư được thu các loại phí hàng hải có liên quan đến hoạt động sản xuất kinh doanh của doanh nghiệp ban hành tại Quyết định số 98/2008/QĐ-BTC ngày 4/11/2008 của Bộ Tài chính.

Các nội dung khác liên quan đến việc thu, nộp, quản lý, sử dụng, chứng từ thu, công khai chế độ thu phí, lệ phí hàng hải chưa quy định tại Quyết định nói trên được thực hiện theo hướng dẫn tại Thông tư số 63/2002/TT-BTC ngày 24/7/2002 và Thông tư số 45/2006/TT-BTC ngày 25/5/2006 sửa đổi, bổ sung Thông tư số 63 nói trên.

Quyết định được đăng Công báo ngày 22/11/2008 và có hiệu lực thi hành từ sau 15 ngày, kể từ ngày đăng Công báo. Bãi bỏ Quyết định số 88/2004/QĐ-BTC ngày 19/11/2004, Quyết định số 89/2005/QĐ-BTC ngày 8/12/2005, công văn số 3404 TC/TCDN ngày 25/3/2005, công văn số 9571 TC/TCDN ngày 8/8/2006, công văn số 165/BTC-TCDN ngày 4/1/2007, công văn số 7904/BTC-TCDN ngày 15/6/2007, công văn số 4812/BTC-TCDN ngày 23/4/2008 và các văn bản khác của Bộ Tài chính trái với quy định tại Quyết định này.
