SELF-EXPLANATORY WL BE KNOWN TO ALL:

我们别无选择只有将这个真实的案例通告给航运界的所有同行们,其中的是非曲直不言自明。

 

WE (OCEANBLUE HOLDINGS GROUP LIMITED) HERE NAMED AS THE CHARTERERS CONCLUDED A FIXTURE NOTE DATED ON 29TH,OCT 2014 WITH MESSR 

”EVERBASE INTERNATIONAL LIMITED” HERE NAMED AS THE OWNER FOR LOADING 9,400MTS IRON ORE FINES EX MACARTHUR,PHILIPPINES TO JIANGYIN,

CHINA WITH LAYCAN 07~12TH,NOV 2014.

我司(OCEANBLUE HOLDINGS GROUP LIMIETD)作为租家跟船东(EVERBASE INTERNATIONAL LIMITED)1029号签订一个航次租约于菲律宾MACARTHUR

9400公吨铁矿至中国江阴港卸,合约规定的受载期:“117~12号”.

 

PERFORMING VSL IS MV.OCEAN FELICITY WHICH PARTICULAR ASF:

执行船舶(MV.OCEAN FELICITY)规范如下:

MV. OCEAN.FELICITY open Iloilo , Phil 7th/Nov,2014

BLT 2009, TWEEN DECKER/BULK CARRIER, NK CLASS,HONGKONG FLAG, BULK

CARRIER, DWT 10,068MT, DRAFT 9.08M,LOA/BM/DEPTH103.64/97.53/13.2M,

GT/NT 6,732/3,259, 2H/2H,G/B 13658/12658 CBMCGO GEAR: DERRIEKS 1

X30METS + CRANES 2 X30MT FOR SINGLE USE, A.D.A WOG;

 

THE SUBJ VSL IS COMMERCIALLY OPERATED BY MESSR:”DAWN SHINE SHIPPING CO.,LTD” WHICH LOCATES IN :”ADD:RM 401 YUNCHANG COMMERCIAL 

BLDG,770 SHENJIA LONG ROAD,SHANGHAI,CHINA”. PIC: GEORGE KEE(纪春国).

MV.OCEAN ELITE( SISTER VSL OF MV.OCEAN FELICITY) ALSO UNDER THEIR OPERATION.

该执行船舶由“上海明耀船务”商业运作,其地址”ADD:RM 401 YUNCHANG COMMERCIAL BLDG,770 SHENJIA LONG ROAD,SHANGHAI,CHINA”。负责人:纪春国

另外一条MV.OCEAN ELITE(MV.OCEAN FELICITY的姐妹船)也由这家公司运作。

 

BEFORE FIXING THIS VSL (MV.OCEAN FELICITY), OUR CLIENT HV FIXED ANOTHER KOREAN VSL TO PERFORM THIS BIZ, DUE TO UNAVAILABILITY OF 

THE STOCKPILE AT PORT OF SURIGAO FOR THE KOREAN VSL TO DISCH HER LAST CARGO, THE KOREAN VSL HV TO REQUEST THE EXTENSION OF 

LAYCAN TILL 13TH,NOV 2014. BUT DUE TO THE L/C RESTRICTION, OUR CILENT HV TO CANCEL THE KOREAN VSL AND LOOK FOR THE EARLIER REPLACEMENT…..

AT THIS TIME, THE OWNER OF MV.OCEAN FELICITY FOUND THE CHARTERERS AND INITIALLY DECLARED THAT THEIR VSL (MV.OCEAN FELICITY) ETA 

LOAD PORT O/A 8TH,NOV FOR LOADING 9,400MTS CARGO, IN VIEW OF HER EARLIER ETA, THIS BIZ WAS CONCLUDED FINALLY.

在签订这条船(MV.OCEAN FELICITY)之前,我们的贸易商已经签了另外一条韩国船舶履行这单贸易,但由于韩国船在SURIGAO卸货遇到堆场紧张导致船舶延迟。

船东当时要求展期至1113号来继续这个租船合同的,但由于信用证的限制,贸易商不得不取消这条韩国船并开始寻找更早的替代船… 这时候,船东联系上我司并

开始声称其船舶(MV.OCEAN FEILCITY)最快可以8号到MACARTHUR装港装9400公吨铁矿,鉴于其更早的船期,这桩合同最终被促成。

以下是船东在订立合约后更新的动态(1030号):

THE DEPOSIT (US$13,000) WAS PAID TO THE OWNER’S NOMINATED BANK ACCT ON THE NEXT TWO BANKING DAYS (16:34 BJ TIME 31ST,OCT 2014) AFTER 

CLEAN FIXED THE SUBJ VSL. EVERYTHING WAS GOING SMOOTHLY UTILL 10TH,NOV 2014, THE OWNER SENT THE FOLL LAYCAN EXTENSION REQUEST 

TO THE CHARTERERS ON THE MORNING OF 1015AM/10TH,NOV 2014:

按照合同约定,13000美金作为订金于订立合同后的两个银行工作日内(支付时间:31号北京时间1634分)支付到了船东指定的银行帐号。之后一切都按照约定进行

直到1110号,船东于1110号上午1015分发了一封邮件要求租家展期至14号:

下面是船东发过来要求展期的邮件:

AS PER LAST CHTRS, VSL NOW DISCHG IN ILOILO, ETD AM/12TH IAGW N WP N UCAE.

PLS THE CHTRS KINDLY CNFM TO EXTEND THE LYCN TB 14TH/NOV.

TKS FOR KIND ASST.

N PLS PUSH THE CHTRS ABOUT CGO DOCS N BARGE READINESS BEFORE VSL ARRIVAL.

THE CHARTERERS HAD NOTIFIED THE SAME TO ALL THE PARTIES CONCERNED AFTER RECEIPT OF THE ABV REQUEST, BUT UNFORTUNATELY, DUE TO THE SAME 

PROBLEM (STRICT L/C RESTRICTION) AS WELL AS THE MARKET FACTORS, THE RECEIVERS REJECTED TO REVISE THE L/C FINALLY, THEREFORE, THE OUTCOME WAS NEGATIVE AND THE SUBJ SHIPMENT HV TO BE CANCELLED AGAIN DUE TO THE OWNER’S BREACH OF THE GOVERNING C/P (MISSING THE CANCELLING DATE ).

在收到船东要求展期的邮件后,租家马上通知所有相关方,但不幸的是历史重演,由于信用证的限制以及市场因素,最后收货人拒绝修改信用证,可想而知,结果是不幸的。

该航次计划由于船东的违约(其执行船舶错过销约期)不得不被再次取消。

 

AFTER CANCELLATION OF THE C/P, THE DEPOSIT (US$13,000) WHICH HAS BEEN PAID TO THE OWNER EARLIER SHOULD BE REFUNDED TO THE CHARTERERS ACCORDINGLY.

合约被取消后,之前支付给船东的订金(13000美金)理应退还给租家的。

 

ON THE DATE OF 11TH,NOV 2014, THE CHARTERERS REQUESTED THE OWNER TO REFUND THE DEPOSIT, THE OWNER PROMISED TO REFUND THE DEPOSIT TO THE CHARTERERS ON THE NEXT DAY (12TH,NOV 2014), BUT WHILE THE CHARTERERS ASKING THE SAME ON THE NEXT DAY,THE OWNER FOUND AN EXCUSE AND BROKE HIS PROMISE.

1111号那天,租家要求船东退还订金,当时船东答应第二天(12号)退还订金的。但第二天,当租家再次问退订的情况时,船东食言并找了借口推迟支付。

 

IN CONSIDERATION OF THE POTENTIAL PARTNERSHIP IN THE FUTURE, THE CHARTERERS GRANT 2 ADDITIONAL BANKING DAYS FOR THEIR REMITTANCE.

考虑到以后潜在的合作关系,租家最后再宽限船东2天退还订金。

 

HOWEVER,2 DAYS PAST AGAIN, WHEN THE CHARTERERS CALLED THE OWNER ( PIC:GEORGE KEE) AGAIN FOR PAYMENT OF THE REFUND ON THE DATE OF 14TH,NOV 2014. THE OWNER DIDN’T SHOW THE EXACT PAYMENT SCHEDULE AND DETAINED THE DEPOSIT WITHOUT ANY LEAGL RIGHTS.

然而,两天又过去了,14号那天,当租家再次电话给船东(负责人:纪春国)问关于退订的情况时,船东却又找借口说一些无关紧要的话题并没任何诚意告知具体退订时间,

而且没有任何合法理由的情况下扣留租家的订金。

 

THE CHARTERERS SENT THE OFFICIAL STATEMENT TO THE OWNER ON 17TH,NOV 2014 REQUESTING THE REFUND OF THE DEPOSIT.BUT SURPRISINGLY, THE OWNER REJECTED THE PAYMENT OF REFUND AND ALLEGING THE CHARTERERS WAS IN BREACH OF THE C/P WITHOUT ANY OFFICIAL EVIDENCE (A VERY VERY FUNNY /GROUNDLESS EXCUSE FROM THEIR MOUTH).

租家于17号当天发严正声明给船东要求其务必归还订金。但令人惊讶的是,船东拒绝退还订金不说,在没有任何书面证据的情况下还反口声称租家违约。

(一个非常非常可笑/毫无根据的借口)

 

IN VIEW OF THE OWNER’S DISAPPOINTING/DIRTY BEHAVIOR (DETAINED THE CHARTERERS DEPOSIT EVEN THOUGH THEIR BREACH OF THE C/P), NO MATTER WHO YOU ARE(CHARTERERS ,OWNER OR BROKERS), PLS BE AWARE OF SUCH DIRTY COMPANY AND AVOID TO DEAL WITH THEM IN THE FUTURE.

鉴于船东令人失望/恶劣的行为(在其违约的情况下还扣留租家的订金),不管你是租船人公司,船东公司还是经纪人公司,请小心/提防这种行为恶劣的公司,以后避免跟这样的公司打交道。

 

THIS KIND OF COMPANY NEVER HONORS THE SPIRIT OF CONTRACT.

这种公司从不尊重合约的精神!
